By purchasing a ticket, you are hereby agreeing to the terms and conditions set forth below:

I understand that by participating in events at McGaffey Flowers that there are numerous obvious and non-obvious inherent risks always present in such activity despite all safety precautions

I agree that should and emergency medical treatment be required, I and/or my own accident/medical insurance company shall pay for all such incurred expenses.

ACTIVITY RISK CLASSIFICATION

I understand that by participating in events at McGaffey Flowers, LLC that there are numerous obvious and non-obvious inherent risks always present in such activity despite all safety precautions.

ACCIDENTAL/MEDICAL INSURANCE

I agree that should an emergency medical treatment be required, I and/or my own accident/medical insurance company shall pay for all such incurred expenses.

LIABILITY RELEASE

I agree that in consideration of McGaffey Flowers, LLC, allowing my participation in this or any activity, under the terms set forth herein, I, the client, for myself, heirs, administrators, personal representatives or assigns, do agree to hold harmless, release, and discharge McGaffey Flowers, LLC, its owners, agents, employees, officers, directors, representatives, assigns, members, owners of premises and trails, affiliated organizations, and Insurers, and others acting on its behalf (Hereinafter, collectively referred to as “Associates”), of and from all claims, demands, causes of action and legal liability, whether the same be known or unknown, anticipated or unanticipated, due to McGaffey Flowers, LLC and or its associates ordinary negligence; and I do further agree that except in the event of McGaffey Flowers, LLC, gross negligence and willful and wanton misconduct, I shall not bring any claims demands, legal action, against McGaffey Flowers, LLC and its associates as stated above in this clause, for any economic and non-economic losses due to bodily injury, death, property damages sustained by me in relation to the premises and operations of McGaffey Flowers, LLC, custody and control of McGaffey Flowers, LLC, whether on or off the premises of McGaffey Flowers Garden Venue.

ALCOHOL CLAUSE

If alcohol consumed at the Client's event Mcgaffey Flowers LLC can not be held responsible for any over intoxication or over serving. Bartending services are not inclusive in the company's services.  The Company is in no way responsible for any accidents involving alcohol, venue property, or the client's property.

STATE OF AWARENESS

I/WE UNDERSTAND, HAVE READ IN FULL AND DO UNDERSTAND THE FOREGOING AGREEMENTS, WARNINGS, RELEASE AND ASSUMPTION OF RISK, I/WE FURTHER ATTEST THAT ALL FACTS RELATING TO THE APPLICANT’S PHYSICAL CONDITION EXPERIENCE, AND AGE ARE TRUE AND ACCURATE.

Limit of Liability

Maximum Damages. Client agrees that the maximum amount of damages he or she is entitled to in any claim relating to this Agreement or Services provided in this Agreement are not to exceed the Total Cost of Services provided by Provider.

Indemnification. Client agrees to indemnify, defend and hold harmless Provider and its affiliates, employees, agents and independent contractors for any injury, property damage, liability, claim or other cause of action arising out of or related to Services and/or product(s) Provider  provides to Client.

Impossibility

Force Majeure Not withstanding the above, either party may choose to be excused of any further performance obligations in the event of a disastrous occurrence outside the control of either party, such as, but not limited to:

1. A natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms or infestation); or
2. War, Invasion, Act of Foreign Enemies, Embargo, or other Hostility (whether declared or not); or
3. Any hazardous situation created outside the control of either party such as a riot, disorder, nuclear leak or explosion, or act or threat of terrorism.

Failure to Perform Services In the event Provider cannot or will not perform its obligations in any or all parts of this Agreement, it (or a responsible party) will:

1. Immediately give Notice to Client via the Notice provisions detailed in this Agreement.
2. Issue a refund or credit based on a reasonably accurate percentage of Services rendered; and
3. Excuse Client of any further performance and/or payment obligations in this Agreement.

I completely understand this agreement to be a release of all claims, known or unknown, present or future, that he/she has or may have against McGaffey Flowers, LLC and its owners/associates. I understand that I have given up substantial rights by signing this agreement and sign it freely and voluntarily without any inducement. I understand that I am participating at my own risk. ALL information below must be filled out, signed, and turned into McGaffey Flowers, LLC before stepping foot onto the property.

This is to certify that I do consent and agree to his/her release as provided above. I release and agree to indemnify and hold harmless McGaffey Flowers, LLC and its owners/associates from any and all liabilities incident to my involvement.
